SALES DESK / REFERENCE 07
Know the role.
Find the source.
Start with the duties you actually perform and the contractor you represent. Use the official registration and public-record sources below; keep a lookup result separate from permission to sell, contract acceptance or project approval.
Which duties should you compare with the HIS guidance?
CSLB’s Home Improvement Salesperson (HIS) overview concerns covered solicitation, selling, negotiation and execution of home-improvement contracts for licensed contractors. Write down your actual duties, the represented business and the question you need resolved. A job title alone leaves too much out. CSLB — Before applying for HIS registration
Before relying on a role label
Keep the activity description, business identity and separately held role documents together. If the facts are unclear, leave an applicability question for CSLB or qualified counsel.
When you need the application path
Follow the current official instructions and linked application. This desk does not submit an application, collect documents or predict processing. CSLB — Applying for HIS registration
What makes an exception more than a title?
The 2026 CSLB book places HIS exceptions in BPC §7152(d), with the personnel-of-record condition for the first three categories in §7152(e). Read those conditions alongside your actual transaction facts. CSLB — 2026 License Law and Reference Book (PDF)
- Record-based paths
- Listed corporate or LLC roles, a listed general partner and a qualifying person have specific conditions. The transaction-time personnel record matters; “manager” in a signature is not the record.
- Activity-limited paths
- The retail-negotiation, appointment-only and service-repair paths describe narrower activities. Compare the complete wording with what you actually do, rather than selecting a convenient label.
- A fact you cannot establish
- Record what is missing and ask CSLB or qualified counsel. This page does not classify you as registered, exempt or qualified.
Use the CSLB laws and regulations entry point to locate the current edition and updates. The basic HIS guidance is a useful starting point; statutory references here follow the verified 2026 edition.
Which public record are you checking?
CSLB offers separate contractor-license and HIS-registration searches. Check the identity you need, read the agency’s record and record when you checked it. This desk performs no lookup. CSLB — Contractor license and HIS registration lookup
| Question | Source to inspect | Keep separate |
|---|---|---|
| Who is the represented contracting business? | The matching contractor license record and actual proposal identity. | The salesperson’s registration and the project’s scope/approval questions. |
| Which salesperson registration record matches? | The HIS name/registration search and the actual role documents. | Employer authorization, a contractor license, craftsmanship and permission to start. |
| What cannot be matched? | Record the mismatch or missing source, without guessing a replacement. | No negative or positive legal verdict follows from this worksheet. |
Which documents protect a clear decision?
Use CSLB’s contract guidance to examine the work description, materials, written changes and offered warranty references. Its homeowner checklist raises permit responsibility, fees and cancellation-rights questions. Bring the actual agreement and notices to the review. - Can the reader identify the actual products, work boundary and separately held version of the writing?
- Which promises remain conversation reports, and which writing is actually available?
- Who is checking the project-specific approval question with the responsible authority?
- Which cancellation notice, communication method and rule apply to the actual situation?
The 2026 reference book includes changes to cancellation communications. Check current materials rather than treating an older general summary as your notice instructions. This desk supplies no notice form or cancellation deadline. CSLB — 2026 License Law and Reference Book (PDF) · CSLB — Laws and regulations
For a homeowner’s proposal comparison, use the existing proposal comparison guide. For an agency question, use the official authority desk; city or county alone does not decide the authority for your work.
How do you keep representation honest?
The 2026 book’s §7152(c) addresses identifying the represented contractor’s business name and license number before the covered activity. Keep that identity distinct from your own role and from HOMEFRONT’s educational tools. CSLB — 2026 License Law and Reference Book (PDF)
The FTC warns about pressure for an immediate decision and advises examining written estimates and actual business evidence. Give the homeowner space to inspect the record; a concern is not a target to overcome. FTC — Avoid a home improvement scam
- Describe only the business role and project evidence you can support.
- Keep a reported selection or discussion separate from agreement and permission to start.
- Say what is unknown; do not invent a credential, review, savings figure, availability deadline or guarantee.
Practice a clear explanation in the Concern Coach. The hypothetical examples there are learning material, not testimonials or project proof.
When does the question need qualified help?
If resolving an exception, notice, disputed agreement or other right depends on interpreting law or the actual documents, take that question to CSLB or a qualified California attorney. Bring the document version, dates you actually know and the exact uncertainty.
The State Bar’s certified-referral directory can be searched by county, issue type and language. The State Bar itself says it does not give legal advice or direct an individual to a lawyer. State Bar of California — Find a lawyer referral service
A useful source question
“These are the duties and documents I can identify. This is the condition or notice I cannot resolve. Which current rule and missing fact should be checked?”
Put the source beside the handoff.
Use the playbook to turn a source question into an attributable record and a named next step.
